1Acceptance of these terms

By downloading, accessing, or using Zmany, you confirm that you accept these Terms and our Privacy Policy, and that you agree to comply with them. If you do not agree, please do not use the Service.

2The service

Zmany is a language-learning app and website that teaches Kurdish (Sorani & Kurmanji) and Iraqi Arabic through bite-sized lessons, audio, and progress tracking. We may add, change, or remove features, courses, or content at any time, and may suspend or discontinue the Service in whole or in part.

3Eligibility

You must be at least 13 years old to create an account and use the Service. By using Zmany, you represent that you meet this requirement and that any information you provide is accurate.

4Accounts & security

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to notify us promptly if you suspect any unauthorized use of your account.
• Each account is for a single individual's personal use; sharing an account is not permitted.
• You can permanently delete your account and associated data at any time from Settings → Account → Delete Account.

5Subscriptions & payments

Zmany offers free and paid (subscription) features. Paid subscriptions are billed and managed entirely through the Apple App Store or Google Play Store — we never see or store your payment card details.

• Pricing is shown in your local currency before purchase.
• Auto-renewal — subscriptions automatically renew for the same term unless cancelled at least 24 hours before the end of the current period, and your payment method will be charged for renewal through your app store account.
• Free trials, where offered, convert automatically to a paid subscription at the end of the trial unless cancelled before it ends; trial length and post-trial price are disclosed before you start the trial.
• Cancellation is managed through your device's account settings (Apple: Settings → [your name] → Subscriptions; Google: Play Store → Payments & subscriptions) — we link to these from inside the app.
• Price changes will be disclosed to you in advance, and, where required, your renewed consent will be requested.
• Refunds are handled by Apple or Google according to their respective refund policies, not directly by us.

6License & acceptable use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Zmany for your own personal, non-commercial language learning. You agree not to:

• Copy, scrape, redistribute, or resell any course content, audio, or imagery from the Service;
• Reverse-engineer, decompile, or attempt to extract the source code of the app;
• Use the Service for any unlawful purpose, or to harass, abuse, or harm another person;
• Post or transmit hateful, political, or discriminatory content, including political symbols or flags, through any part of the Service that accepts user input;
• Interfere with or disrupt the Service, or attempt to gain unauthorized access to it.

7Intellectual property

The Service, including all course content, lesson text, audio narration, illustrations, the Zmany name, logo, and the Tûtî mascot, is owned by Zmany or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

8User content

If the Service ever allows you to submit content (for example, a profile name, or content shared with friends via future social features), you grant us a worldwide, royalty-free license to host, display, and use that content solely to operate and improve the Service. You remain responsible for anything you submit, and we may remove content that violates these Terms.

9Third-party services

Your purchase and use of in-app subscriptions is also subject to the Apple Media Services Terms and Conditions or the Google Play Terms of Service, as applicable. If those terms conflict with these Terms on billing matters, the applicable app store's terms control for that matter.

10Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that using it will result in any particular level of language proficiency.

11Limitation of liability

To the maximum extent permitted by law, Zmany will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.

12Indemnification

You agree to indemnify and hold Zmany harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.

13Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent or abusive behavior, or if we discontinue the Service. Provisions that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability) will survive.

14Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice to admin@clevaite.com including a description of the work, the material you believe infringes it, and your contact information. We aim to respond within 14 days.

15Governing law & disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts of the State of Wyoming, United States, unless applicable consumer-protection law in your country of residence gives you the right to bring a claim in your local courts.

16Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before the changes take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

17Miscellaneous

• Severability — if any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
• Entire agreement — these Terms and our Privacy Policy are the entire agreement between you and Zmany regarding the Service.
• No waiver — our failure to enforce any right or provision is not a waiver of that right.
• Assignment — you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
